ARTICLE 1: SCOPE OF APPLICATION
1.1 – The present general terms and conditions of sale govern, exclusively, the contractual relations between CHARPENTERIE LE COZ (hereinafter referred to as CHARPENTERIE LE COZ) and any person (hereinafter referred to as "the customer") who places an order on the commercial website (hereinafter referred to as "the site") via the following address: cloze.fr

1.3 – The present general conditions are applicable to all the items offered for sale on the site, and are reserved for customers over 18 years of age who have full legal capacity.
1.4 – Any order of one or more items presented on the site implies the consultation and acceptance without reserve, on the part of the customer, of the present general conditions of sale as well as of the prices applied. The present conditions prevail over any other document as well as over the general sales conditions of the customer’s country.
1.5 – Any failure on the part of CHARPENTERIE LE COZ to fulfil one of its obligations, as mentioned in the present general conditions of sale, may under no circumstances be interpreted by the customer as a waiver of the general conditions of sale.
These conditions may be updated or modified without prior notice. The applicable conditions will then be those in force at the time of the conclusion of the contract, i.e., on the day the order is processed.
ARTICLE 2: INFORMATION ABOUT THE ITEMS
2.1 – The items and promotional offers, present on the site, are offered for sale within the limits of available stocks and for the offers, until the end of their validity. The presence of an item on the site does not guarantee its availability in stock.
2.2 – All items on the site presented for sale are reserved for private individuals.
2.3 – The images and descriptive text illustrating the items are given only as an indicative guide and do not enter into the scope of the contract. Consequently, although represented on the site with the greatest precision, the images and descriptive text may, however, contain errors. In this event, CHARPENTERIE LE COZ cannot be held responsible.
ARTICLE 3: ORDERING ITEMS
3.1 – Orders are placed on the site at the following address: cloze.fr
The items offered for sale are subject to availability. If a product is unavailable, the customer will be informed by e-mail or by post after placing the order. The order will not be validated until the customer has paid in full. CHARPENTERIE LE COZ reserves the right to refuse certain orders that are deemed invalid.
3.2 – Order validation:
If the customer wishes to purchase one or more items, he/she must select a model or its reference, define the quantity and then click on "basket". The basket summarises the customer’s selection and allows them to modify their order. To validate the chosen products, the customer must click on "order".
Once this step is completed, the customer will identify himself, either by using his customer code or by entering his personal data in the space provided. The customer must then choose the method of payment, pay the amount of the order and validate the information that appears on the final order form. An order number will be issued to the customer. CHARPENTERIE LE COZ will keep the record of the order as proof of the contractual relationship between the parties.
ARTICLE 4: ITEM PRICES
The prices indicated on the site are in euros and are inclusive of all taxes (French VAT included). Any change in the legal rate of French VAT will be reflected in the price of the products presented on the site.
Prices do not include postage and packaging costs which are to be borne by the customer and which will be specified when the order is placed.
The prices presented may be modified at any time by CHARPENTERIE LE COZ.
ARTICLE 5: PAYMENT AND SECURITY
When paying for an order, the customer will have the choice between the following methods of payment:
- Payment by credit card (unless the server is unavailable)
- Payment by cheque
5.1 – Terms and conditions for payment by credit card:
All purchases can be paid directly on the site by the customer. The amount of the order will only be debited at the time of its validation. Payment by bank card is secured by an encryption system…
Consequently, CHARPENTERIE LE COZ cannot access the customer’s credit card number which is transmitted in complete confidentiality. Only national bank cards will be accepted by the security system as well as Visa, Eurocard and Mastercard.
5.2 – Terms and conditions for payment by cheque
The customer can send a bank cheque by post, made out to CHARPENTERIE LE COZ, accompanied by a photocopy of the customer’s passport or identity card, to the following address CHARPENTERIE LE COZ, 229 Rue Des Chênes, 44440 RIAILLÉ
The cheque will be deposited at the bank for cashing as soon as it is received.
For all methods of payment, the purchase amount must be paid in full and in one go on the day of the order. Orders will be validated and processed, after acceptance of payment, by the banking centres concerned (for payments by credit card, visa, Eurocard, Mastercard) or after receipt of payment (for bank cheques).
In the event of a payment dispute with a customer, CHARPENTERIE LE COZ reserves the right to refuse the order.
ARTICLE 6: DELIVERY
6.1 – Methods of transport:
Orders can be delivered anywhere in the world. CHARPENTERIE LE COZ reserves the right to choose the appropriate mode of transport. Orders will be delivered in France by Colissimo or another operator.
6.2 – Delivery of the products will only be effective after receipt of the total amount of the order. The products will be delivered to the address indicated by the customer when placing the order. Consequently, the details given by the customer are considered to be correct and will not engage the responsibility of CHARPENTERIE LE COZ in the event of a dispute. In the event of the customer’s absence at the time of delivery, the carrier will leave a delivery notice at the indicated address.
6.3 – The average delivery time is 10 days. It is given for indicative purposes only and does not constitute a firm commitment on our part.
6.4 – Delivery outside metropolitan France:
The delivery costs indicated when placing the order only concern deliveries in metropolitan France. Delivery rates outside metropolitan France will be calculated once the customer has specified the country to which he/she wishes to be delivered.
6.5 – We have a section on the site dedicated to tracking your orders, which we encourage you to visit on a regular basis.
6.6 – Receipt of products:
The customer is advised to check the condition of the products received before signing the delivery note. Once the delivery note has been signed, CHARPENTERIE LE COZ will consider that the customer has carried out this check.
ARTICLE 7: RIGH OF WITHDRAWAL
7.1 – By virtue of the provisions of articles L.121-20 et seq. of the Consumer Code, the customer has a period of seven clear days to exercise his right of withdrawal without having to justify his reasons, from the date of receipt of his order. The shipping and return costs will be charged to the customer. The products, accompanied by the Bank Transfer Information of the customer, will have to be returned by post, in a perfect state and in their original packaging (including accessories and user manual) to the following address: 229 Rue Des Chênes 44440 RIAILLÉ
Refunds will be made by crediting the customer’s bank card within … days. In case of return of a damaged, incomplete or spoiled product, it will not be exchanged or refunded.
ARTICLE 8: PRODUCT CONFORMITY AND GUARANTEE
8.1 – In the event of non-conformity of the products, we ask the customer to inform us by mail, accompanied by the items concerned, in a new condition as well as in their original packaging, within 15 working days, to the following address: 229 Rue Des Chênes 44440 RIAILLÉ
8.2 - Guarantees
The customer benefits from the legal provisions relating to the guarantee of hidden defects under article 1641 and following of the civil code.
ARTICLE 9: RETENTION OF TITLE AND CANCELLATION CLAUSE
9.1 – The products ordered remain the property of CHARPENTERIE LE COZ, until the customer fulfils his obligations, in particular until he pays the full price. Once the transfer of ownership has taken place, the risks of loss, theft or deterioration of the products are the responsibility of the customer.
9.2 – In the event that the buyer fails to fulfil one of his obligations, the sale will be terminated automatically and without notice. The items must be returned to CHARPENTERIE LE COZ within 48 hours.
ARTICLE 10: PERSONAL INFORMATION
10.1 – The customer expressly agrees to communicate his personal data to CHARPENTERIE LE COZ so that we can manage orders, deliveries and customer relations as well as possible.
In accordance with the law of 6 January 1978, relating to information technology and civil liberties, the customer has the right to access and rectify his personal data. CHARPENTERIE LE COZ undertakes not to communicate your personal data to third parties.
ARTICLE 11: INTELLECTUAL PROPERTY RIGHTS
The CHARPENTERIE LE COZ site and its contents are protected by the legislation in force on copyright and intellectual property. In accordance with the provisions of the Intellectual Property Code, CHARPENTERIE LE COZ grants the customer a licence to use the site, solely for personal use. ARTICLE 12: FORCE MAJEURE
In the event of partial or total non-performance of its obligations, caused by a case of force majeure or fortuitous event, CHARPENTERIE LE COZ shall not be liable.
According to the provisions of article 1148 of the French Civil Code, force majeure is a case of unforeseeable and irresistible events. The following are expressly considered as cases of force majeure

- Floods, fires, lightning, natural disasters…
ARTICLE 13: APPLICABLE LAW AND JURISDICTION CLAUSE
The present general terms and conditions of sale are written in the French language and are governed by French law. In the event of a dispute between the parties, the court with territorial jurisdiction shall be the Commercial Court of France.
